1. Terms and conditions:

The general terms and conditions of the online store are made in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1) and the Law on Electronic Communications (ZEKom-1). We reserve the right to change the terms and conditions.

The online store is managed by the company Kovinoplast Ambrož Kavs s.p., Brežič 9, 5220 Tolmin.

The general terms and conditions determine the functioning of the online store, the rights and obligations of the customer and the store, and regulate the business relationship between the company Kovinoplast Ambrož Kavs s.p. (seller) and the customers.

The customer is bound by the general terms and conditions valid at the time of the purchase (online order).

The costumer can choose and order the products available on the product list. All products listed on the store’s website are available until the stock is sold out. The sales contract between the seller and the customer is concluded when the seller confirms the order and the customer receives an e-mail confirming the order. From this moment on, the prices and terms of sale are binding for the seller and the buyer.

Kovinoplast Ambrož Kavs s.p. company is committed to providing all information available to the customer concerning the business of the online store in relation to him. Due to the maintenance and upgrading of the website, occasional short-term restrictions may occur in access.

2. Validity of Terms and Conditions

The following conditions apply to any sale of products or services by the company Kovinoplast Ambrož Kavs s.p. from the date of confirmation and publication of the company, to its cancellation.

Any changes of these conditions apply only if they are confirmed in writing. Oral arrangements must also be confirmed in writing.

A written confirmation includes: fax receipts, e-mails and other media that can be saved.

The agreed deviation from the individual points of the general terms of sale does not affect the validity of other provisions.

When the order is confirmed, or at the latest at the time of the acceptance of the goods, the client accepts our general terms and conditions, unless otherwise specified in the offer or contract.

 

3. Prices

All prices are in EUR.

The seller reserves the right to change the prices without prior notice. Obvious errors when quoting the bid or confirming the order do not oblige us to deliver the goods at the stated price.

 

4. Payment and payment terms

The minimum amount of purchase is 50, 00 €.

The number of the order must be indicated in the reference. The goods must be paid in full before the shipment.

– Personal collection of goods

The ordered goods can be collected personally at the headquarters of our company (Kovinoplast Ambrož Kavs s.p., Brežič 9, 5220 Tolmin). Goods can be picked up personally upon prior payment (bank transfer) to the business account and by prior agreement with the seller, but not earlier than the payment is shown on the seller’s account. The customer makes the agreement with the seller via e-mail or telephone.

 

5. Delivery

The price for a limited number of items throughout all Europe Union depends on the weight. Free shipping is valid on orders 300 € or more.

0-2 kg – 20 EUR

2-5 kg – 25 EUR

5-8 kg – 35 EUR

The ordered goods are dispatched as soon as the payment has been received.

If items are in stock, the delivery time is 8-15 working days.

The seller will deliver the goods or services within the agreed time. In the event that the order is submitted and confirmed by 10 am, the goods will be shipped on the same day. Shipments are dispatched from Monday to Friday (excluding holidays). Orders confirmed on Friday after 10 am will be shipped on Monday. Before the order, the customer must check that the product is in stock. In case the product is not in stock, the delivery time is 10-15 working days.

The primary partner for the delivery of shipments is GLS, but the seller reserves the right to choose another delivery service if this can make the order more efficient.

 

6. Options of payment

Payment is possible only via online bank transfer.

7. Returns and refunds

The customer can return the goods within fourteen (14) days of the purchase in case:
– the goods do not have the features explicitly promised by the seller;
– the seller sent the wrong products;
– the products do not match the ordered quantity;
– the products differ from the customers’ order otherwise.

The goods must be returned undamaged and unchanged, unless the goods have already been destroyed, lost or their quantity changed without any fault of the customer. The original packaging of the product must also be undamaged and unchanged.
Refunding the amount paid or part thereof shall be made as soon as possible or within 30 days at the latest. Refund is made to the customer’s account.

In the event of a refund of goods due to a complaint, a complaint must be sent to the address of the seller. If the claim is justified, the customer has the right to choose another product from the offer or ask for a refund.

In this case, the customer may request an immediate replacement for the same product.

In the event of a complaint, the customer is obliged to return the product to the supplier.

If the customer finds that the item or package is damaged when the item is received, it contains no content or displays any signs of opening, we must be informed immediately so we can initiate the complaint procedure to the delivery service.

If the complaint is justified, we are committed to repair defects in the goods as soon as possible or change the product with a good one, but if neither is possible, we agree to reduce the selling price.

 

8. Cancellation of the order

In the event that the customer terminates its order, the customer is obligated to settle all costs which were created by the order.

 

9. Complaints

Company Kovinoplast Ambrož Kavs s.p. respects the applicable consumer protection regulations and has an effective complaints handling system. Customers can call our complaint helpline: tel.00386 (05) 3819710 or contact us via e-mail: reklamations@kavs.eu. The complaint procedure is confidential.

With all legal procedures between the client and the seller are respected only the laws of the Republic of Slovenia.

The court in Nova Gorica is responsible for resolving any disputes.

 

10. Protection of personal data

Company KOVINOPLAST AMBROZ KAVS S.P., e-mail info@kavs.eu, operates with the personal data collected via the website www.distancniki.si.

KOVINOPLAST AMBROZ KAVS S.P. commits to protect the personal data transmitted in accordance with the Personal Data Protection Act (ZVOP-1). All data provided will be treated confidentially.

Personal information of the individual client KOVINOPLAST AMBROZ KAVS S.P. processes and stores them in order to achieve the purpose for which the individual has provided them:

When dealing with indirect and directly transmitted data, we are bound by the Personal Data Protection Act, which defines the rights, obligations, principles and measures that prevent unconstitutional and unjustified interference with the privacy and dignity of an individual.

KOVINOPLAST AMBROZ KAVS S.P. for the purposes of the order keeps the following personal information: name, surname, email, address.

KOVINOPLAST AMBROZ KAVS S.P. commits not to provide any personal information to third parties, in the EU or outside the EU, EEA and international organizations of this area, except where this is in accordance with applicable law.

KOVINOPLAST AMBROZ KAVS S.P. will protect the personal data and prevent using them. Personal data will only be used for the purposes for which the user has given his consent. KOVINOPLAST AMBROZ KAVS S.P. undertakes to keep the collected data only as long as it is strictly necessary to achieve the purpose for which it was collected.

After the termination of the need to manage personal data, the data is deleted or the data carriers are destroyed.

Users have at any time the right to request the change or deletion of their personal information via e-mail info@kavs.eu. The data will be deleted as soon as possible.

Abuse of data

We commit ourselves to protecting your personal information in accordance with GPDR. In case of the abuse of data, we will notify you via e-mail address as soon as possible, but not later than within 72 hours.

 

11. Legal notice

LIMITATION OF RESPONSIBILITY

By maintaining the contents of the website, the manager will try to ensure the accuracy of the data, but it does not guarantee their accuracy. All users use the published content at their own risk. The maneger reserves the right to change, add or remove web pages or content (in whole or in a part) without prior notice and shall not be responsible for any consequences of such changes.

COPYRIGHT

All information and the content (texts, photos) presented on this site are subject to copyright protection and other forms of personal property protection. The use of copyrighted content for commercial purposes, without the prior written permission of the manager, is prohibited and constitutes a violation of the regulations.

The reproduction of the written content of the website is allowed exclusively for non-commercial purposes and must contain all the above warnings about copyrights.

 

12. Warranty conditions

All goods delivered have a warranty period of 24 months from the date of delivery.

The guarantee shall cease to apply when an unauthorized person intervenes in to the product or by the installation of worn-out or spare parts not prescribed by the manufacturer. The warranty will expire if our products are used on a racetrack or for racing purposes.

For damage or damage on the goods resulting from incorrect assembly, incorrect settings that are not in accordance with the foreseen, we do not recognize warranties.

All warranty claims must be written

In the case of a justified complaint, we commit to repair or replace the goods free of charge as soon as possible. The place where the complaint will be resolved is Kovinoplast Ambrož Kavs s.p.

In the event of unjustified claims, the customer is obligated to return all costs which were created with the claim.

 

13. Property assistance

All goods remain our property until the customer’s obligations regarding the goods delivered are fully met, including the payment of any fees and interest charges for late payment. In case the buyer sells the goods ahead of the expiry of the payment period, the resulting claims must be passed on to us in the amount of the selling price of our goods.

The customer is obliged to inform his/her buyer of our ownership clause.

In case the customer’s goods are seized in which our products are presented by a third party, the client must immediately inform the third party of our ownership clause.

 

14. Warranty for quality

We guarantee the quality of the delivered goods in accordance with our catalogue data or specially agreed requirements.
